  1. You and/or the moving company must notify a member of the A&E Committee (see telephone number listed) 1 or 2 days PRIOR to the delivery date of your mobile home. They will help you or the delivery driver/company choose the best route for the delivery and make arrangements for someone to meet them at the construction gate, (South).

  2. Wait at least 48 hours after a rain to have your home delivered. Five Lakes roads can be muddy and trucks or mobile homes may get stuck. Again - CONTACT an A&E Committee member before delivery.

  3. Travel trailers for temporary housing can only be approved by the BOARD and only during the construction or site preparation for approved permanent housing that are defined in CCR #27. Under NO circumstances shall the time exceed ninety (90) days.

Five Lakes Property Association Members are responsible for any damages that may occur during the move-in and set-up of a mobile home during any construction, and during delivery of buildings or supplies to Five Lakes.

Five Lakes Property Association Members are responsible for any damage to common areas of the Five Lakes and property owned by members. This also includes, but not limited to roads, drainage ditches, culverts, fences, gates, signs, sewer lines, trees, shrubs or grassed areas.

If damage occurs and the property owner has not corrected the problem within 15 days, the FLPOA Board will make arrangements to have the issue corrected and the member will be billed accordingly. Should the homeowner need help or guidance about how to do the repairs they may contact the FLPOA office or A&E Committee.

By signing above, you are acknowledging that you have read this Application and Agree to abide by all requirements. BE SURE TO READ AND FOLLOW THE FLPOA COVENANTS

The following Covenants Pertaining to Five Lakes will be strictly enforced.

Covenant #26 Structures(s). No structures shall be erected on any lot until a Construction Permit has been approved in writing by the FLPOA A&E Committee.

  1. Each construction permit must include the size, height, and location on the lot of structure.

  2. No permanent structure shall be constructed on or across utility easements or common ground. c) No structure may be constructed of used materials unless approved in writing by the A&E Committee.

SPECIAL ASSESSMENT: MEMBERS WILL BE ASSESSED $100.00 PER MONTH UNTIL COMPLIANT

Covenant #27 Mobile Home Placement: Members must have a permit signed and approved by FLPOA A&E Committee during the placement of mobile home and during the construction of all decks and/or appurtenances.

a) Mobile homes must be at least fourteen (14) feet wide with a minimum floor area of 840 square feet. b) Mobile homes must be no older than four (4) years old when set on any lot in Five Lakes. Mobile homes one (1) to four (4) model years old may be subject to inspection and approval by the A&E Committee.

  1. No more the one (1) mobile home shall be placed on any lot.

  2. A mobile home must have a permanent cement foundation or cement block pillars, and it must be secured to the foundation or tie downs to in-ground anchors. Mobile home tie downs must meet state codes.

  3. Mobile homes must have a front deck/porch, constructed of new wood, metal or other durable material. Decks/porches MUST be attached to the mobile home OR secured to the ground. Each deck/porch must be at least forty (40) square feet and be skirted with approved material.

  4. Mobile homes are NOT allowed to be moved within Five Lakes.

  5. Anchoring, skirting and decks must be completed within forty-five (45) days of placement of mobile homes unless an extension is granted by the FLPOA A&E Committee

  6. All construction material and trash MUST be removed within thirty (30) days.

  7. The FLPOA Board of Directors may, upon application and hearing, grant a temporary variance for the use of a recreational vehicle for living quarters by the members while the mobile home is being placed and set-up. Under NO circumstances shall the variance exceed ninety (90) days.

  8. No structure, including mobile homes, garages, carports, porches/decks, etc. shall be placed on any lot closer than:

    1. 20 feet from the members front LOT line

    2. 5 feet from either side lot line except corner lots

    3. 10 feet from the side street line

    4. 5 feet from the members rear lot line

SPECIAL ASSESSMENT: MEMBERS WILL BE ASSESSED $200.00 PER MONTH UNTIL COMPLIANT

Covenant #28 House Construction: Members must have a permit signed and approved by the FLPOA A&E Committee during

 construction of a single-family residence.

  1. The house must have a minimum of 1200  square feet of living space, excluding porches, carports, patios and/or garages.

  2. All porches and decks must be skirted with approved materials.

  3. Each house MUST be constructed of new materials.

  4. Exterior construction must be complete within six (6) months after slab or foundation has been installed unless an extension is granted by the FLPOA A&E Committee.

  5. The FLPOA Board of Directors may, upon application and hearing grant a temporary variance for the use of a recreational vehicle by the member as temporary housing during construction of a house. Such recreational vehicles shall be secured and properly connected to water and sewer. Upon connection of said RV to sewer the lot shall be considered improved and sewer charges will be assessed. Under no circumstances shall the variance exceed six (6) months.

  1. No structure, including mobile homes, garages, carports, porches/decks, etc. shall be placed on any lot closer than:

  1. 20 feet from the members front LOT line

  2. 5 feet from either side lot line except corner lots

  3. 10 feet from the side street line

4. 5 feet from the members rear lot line

Covenant #29 When two (2) or more adjacent lots are owned by a single member, the side lot lines refer only to the lot lines bordering adjoining members' lots. This is accepting those boundaries where utilities may be buried previous to lot purchase.

Covenant #30 NO structures are permitted on utility easements within the subdivision.

Covenant #31 A member who has a residence in the Subdivision may erect an outbuilding on a separate improved or unimproved lot upon approval by the FLPOA A&E Committee.

Covenant #32 All improved lots shall be used solely as single family residential lots except Block 2-Lot 21 which is owned by Buckhorn Water Corporation, and upon which is situated a Buckhorn Water owned tower.

Covenant #33 Subdivision lots are not to be acquired by non-resident members for storage facilities.

Covenant #34 A lot is considered "unimproved" unless sewer is connected thereon. If the home/structure has been removed the status reverts to "unimproved". If subsequently a home is placed on said lot the lot will revert to "improved".

Covenant #35 A driveway consisting of gravel, concrete or asphalt shall be REQUIRED for each residence, garage and/or carport. The gravel, concrete or asphalt will be maintained and reasonably free of weeds and grass.

SPECIAL ASSESSMENT: MEMBERS WILL BE ASSESSED $100.00 PER MONTH UNTIL COMPLIANT

Covenant #36 Fences: Fences must be approved by the FLPOA A&E Committee before AND after installation.

  1. Fences must be made of chain link, new wood, metal or vinyl.

  2. Fences must not extend eight (8) feet tall.

  3. Front yard further forward than the street facing wall of a home/residence may not be taller than three (3) feet tall, can be of chain link, new wood or vinyl. Front yard fences must not block the view.

  4. The FLPOA A&E Committee may issue a temporary permit for the fence not to exceed ninety {90) days. SPECIAL ASSESSMENT: MEMBERS WILL BE ASSESSED $100.00 PER MONTH UNTIL COMPLIANT
